Club for Growth Files Indiana Amicus Brief Defending Indiana SD-23 Primary Result

INDIANAPOLIS, Ind. — On Monday, Club for Growth filed an amicus (or “friend of the court”) brief in the Indiana Supreme Court supporting the certified winner in the primary election for Indiana’s 23rd Senatorial District, Paula Copenhaver.  Club for Growth PAC supported Copenhaver against losing challenger and incumbent Spencer Deery because he opposed President Trump’s call for Indiana to redistrict its Congressional seats. Club for Growth Action invested over $2 million in 8 races, including ousting Deery and 5 other RINO state Senators who opposed the President.

The Club argues that Deery’s case is moot because the lawful deadlines set by the General Assembly have passed and the Recount Commission’s certification of Copenhaver as the winner was correct. The election is over and it is time for losing Senator Deery to move on.

“Indiana’s election calendar isn’t a suggestion, it’s the law,” said Club for Growth President David McIntosh “The General Assembly set the deadlines in advance for every candidate. The recount is finished, the nominee is certified, and the ballots are being prepared. Rules should not change after the ballots are counted. Club for Growth is standing with Paula Copenhaver because the standard must be the same for every candidate, every time.”

“Senator Deery is asking this Court to throw out the very safeguard that proves an absentee ballot is real and is the one the voter actually sent in. Indiana law says a ballot must carry the clerk’s signature and seal. That rule exists to keep votes from being stolen by election officials, and enforcing it is how this Court protects both voters and the integrity of the election itself,” said lead counsel and national election lawyer James Bopp, Jr., who authored the brief with Club for Growth General Counsel, Michael Donnelly and Bopp Law Firm Associate Counsel Taylor Shetina.
